Do You Have Your Regulations and Law Available?

Are you confident that your service is fully compliant, and do you have access to the most up to date version of the National Law and Regulations?

One of the most common breaches in Family Day Care (FDC) services relates to Regulation 185: Law and Regulations to be Available.

This regulation requires the approved provider to make sure that a copy of the Law and the Regulations is always accessible at the education and care service premises. A compliance direction may be issued for failure to comply with this regulation.

Key points to remember:

  • Accessible at all times: A copy of the National Law and Regulations must be available at the education and care service premises at all times.
  • Who requires access? Nominated supervisors, service staff, coordinators, relief educators, volunteers, parents of enrolled children, and anyone else who might need to use the service must have access. Ensure everyone knows where these documents are located and that they understand their importance.
  • Family Day Care Specifics: For FDC services, the National Law and Regulations should not only be accessible at the principal office but also at each educator’s residence or venue.
  • Electronic format: The National Law and Regulations can be provided in an electronic format. This ensures you always have the most current copy available. Regular checks should be conducted to ensure the principal office and educators have the latest edition.

Educators should contact their approved service for guidance on how to access the regulations and the law as required by their service.

Preventing Infectious Diseases in Early Childhood Education and Care

Every education and care service must ensure that risks associated with infection are prevented or minimised as far as is reasonably practical.

The National Health and Medical Research Council (NHMRC)  has released a new edition of Staying healthy: Preventing infectious diseases in early childhood education and care services (Staying healthy).

Staying healthy is a best practice resource of simple and effective ways for educators and staff to help limit the spread of illness and infectious diseases in education and care settings. Developed by the NHMRC Staying Healthy Advisory Committee, it is designed to be used by anyone educating and caring for children and young people including all long day care, family day care, preschool, kindergarten and outside school hours care services.

Importantly, Staying healthy has been developed in alignment with the National Quality Framework and includes references to the Education and Care Services National Law and Regulations and the National Quality Standard.

The latest edition incorporates new evidence and perspectives from the past 10 years and updated scenarios based on real life situations that illustrate key messages and appropriate actions. It also includes 5 key practice recommendations for services and educators.

In response to community comments and enquiries received by NHMRC on the fifth edition, fact sheets on symptoms and diseases have been added to the guideline. Both fact sheet format and content have been updated to present clear information about symptoms and conditions for educators and other staff, parents and carers.

Recipes for Fun in FDC

After a great response from our first Recipes for Fun in FDC, we’re excited to let you know we will be having another call out this week!

We love seeing the inventive creations that Educators share on social media and want to share them with our online community. By sharing these creations with our community, we hope to inspire Educators to try out something new.

In the coming days we will put a call out via Facebook to share an activity, provocation or resource that you’ve created and the children loved. Educators will be able to take part by sharing a picture and caption of their creation. If selected, we’ll ask for short step-by-step instructions (including photos) for the activity so we can make a how-to guide for other Educators to follow.

The lucky Educator who is selected to share their creation will win a $50 visa gift card!

Our focus is to keep the activities simple and cost effective, so that all children and Educators can jump in and have fun.

We can’t wait to see, and share, your great ideas!
